Regulations, DEP Regulations 7.00 and NESHAP Regulations.
(1) Persons engaged in asbestos work shall only be assigned to perform those tasks authorized by a valid current certificate.
(2) At least one certified supervisor/foreman shall be assigned to and be present at each asbestos project job site when work is in progress.
(3) All persons engaged in asbestos work should keep their certification identification card at their job site and shall present in upon request.
(4) Warning signs shall be posted at all approaches to the work ares. Signs shall be posted a sufficient distance from the work area to permit a person to read the sign(s) and the precautionary measures to avoid exposure to asbestos.
(5) All movable objects shall be removed from work area.
POLICY STATEMENT
Re: Asbestos Removal: Roof and exterior siding
Asbestos material to be removed from the above noted areas must be performed by a Licensed Asbestos Contractor*.
This policy applies to single and multiple dwellings, as well as, commercial property within the Town of Brookline.
As always, all asbestos abatement requires a plan review and approval (with fees) by the Health Department.
Persons failing to comply with this policy will be deemed in violation of i4GL Chapter III; Sect 122, 124. punishable by criminal actions and assessment of a fine.
*As defined in DLI Regulation 453 CM 6.03 (1) and (2).

Chapter II, State Sanitary Code
410.353: Asbestos Material Used as Insulation or Covering on
Pipes, Boilers or Furnaces
(A) Every owner shall maintain all asbestos material used as insulation or covering on a pipe, boiler or
furnace, in good repair, and free from any defects which may allow the release of any powdered, crumbled or pulverized asbestos material. Every owner shall correct any violation of 105 CMR 410.353 by: repairing the asbestos material in accordance with 105 CMR 410.353
(B), by enclosing the asbestos material in accordance with 105 CMR 410.353 (C), or by removing the asbestos material in accordance with 105 CMR 410.353 (D).
(B) If, the owner chooses to repair asbestos material, the owner may utilize any repair method provided that such repair method:
(1) Is approved by the Brookline Health Department or its agent as suitable for the particular defects being repaired, and
(2) Results in the elimination of all defects which may allow the release of any powdered, crumbled or pulverized asbestos material.
Any paint, patching compound, fiberglass material, and any product intended by the manufacturer for the repair of asbestos material shall be mixed and/or applied according to the manufacturer’s instructions or specifications.
(C) If, the owner chooses to enclose asbestos material, the owner may utilize any method of enclosure provided that the completed enclosure prevents the release of any powdered, crumbled, or pulverized asbestos material. Any panel, board, door or plate which may be easily opened or removed, including a drop ceiling with removable panels, or which may be opened or removed in the course of routine maintenance of the dwelling or of any fixture or equipment in the dwelling, shall not be considered a suitable enclosure.
(D) If, the owner chooses to remove asbestos material, the owner shall submit an asbestos removal plan to the Brookline Health Department. The plan shall include a description of the location, nature, scope and method of removal, the measures that will be taken to prevent the escape of asbestos material and to protect persons engaged in the removal work, the place and method of disposal of asbestos material, and the name of the remover. No removal work shall commence before the removal plan has been approved by the Health Department.
Note: Owners should be aware that State regulations (453 CMR 6.00) provide that “No person, firm,
corporation or other entity shall enter into, engage in or work at the business of asbestos abatement unless
such person has been duly cerified…”

When asbestos material used as insulation or covering on a pipe, boiler or furnace is found to be defective, the owner shall correct the violation by repair, enclosure, or removal.
Removal Plan – If, in order to correct a violation of 105 CMR 410.353 (A), the owner chooses to remove asbestos material, the owner shall submit an asbestos removal plan to the Brookline
Health Department.
1. The plan shall include the following:
A. A description of the location.
B. Nature, scope and method of removal work.
C. Place and method of disposal of asbestos material.
D. Name of the remover.
2. Town of Brookline application must be submitted no later
than 14 days prior to starting date.
3. $35.00 fee for each address.
No removal work shall commence before the removal plan has been approved by the Health Department.
Jobs starting without prior Health Department approval will be charged Triple the amount indicated.
Upon approval of the asbestos plan the Health Department shall notify, in writing, the owner that removal work may commence.
Removal Work – During any removal work:
(1) Persons engaged in asbestos removal shall only be assigned to perform those tasks authorized by a valid State certificate.
(2) At least one certified supervisor/foreman shall be assigned to and be present at each asbestos project job site when work is in progress.
(3) All persons engaged in asbestos work should keep their certification identification card at their job site and shall present is upon request.
(4) Warning signs shall be posted at all approaches to the work area. Signs shall be posted a sufficient distance from the work area to permit a person to read the sign(s) and the precautionary measures to avoid exposure to asbestos.
(5) All movable objects shall be removed from work area.
(6) All non-movable or fixed objects remaining within the work area shall be wrapped or covered with six (6) mil thick plastic sheeting. The covering shall be completely sealed with duct tape or equivalent.
(7) The work area shall be isolated by sealing all openings including but not limited to windows, doors, ventilation openings, drains, grilles and grates.
(8) Floor and wall surfaces shall be covered with plastic sheeting (polyethylene sheeting).
(9) A three compartment decontamination system to be installed on all asbestos removal; exception 453 CMR 6.14, sec. 6, sec. 7.
(10) Air testing to be performed upon completion of abatement. In no case shall clearance air monitoring
samples be collected by the contractor or an employee of the contractor.
(11) Prior to removal, asbestos material shall be thoroughly wetted with water to which surfactant has been added.
(12) Removed asbestos material shall not remain in the work area, asbestos shall be contained in double (2) plastic bags
(6 mil) minimum thickness each.
(13) Protective clothing and equipment: Personnel protective clothing shall mean full body disposable clothing, including head, body and foot coverings consisting of material impenetrable by asbestos fibers.
(14) Asbestos waste will be transported in closed trucks for disposal at approved landfill location.
(15) Negative air pressure will be continuously maintained during asbestos removal by use of HEPA filtration units.
(16) A complete cleanup of the work area will be performed using the wet wipe method along with HEPA vacuums.
A $35.00 fee payable to the Town of Brookline must be submitted with this application ($35.00 will be charged for each address, listed at job location.)
-Jobs canceled without informing the Health Department at least 24 hours in advance will be required to submit a new application and fee.
Jobs starting without prior Health Department approval will be charged TRIPLE the amount indicated
