Dumpster Regulations

1. “Dumpster” means any receptacle of 75 gallons’ capacity or more which is used for the collection, storage or transportation of trash, rubbish, garbage, offal, scrap, or other material for discard, disposal or recycling.

2. “Owner” means any person, including a lessee or mortgagee in possession, who alone or severally with others has lawful title to or possession, care, control of any property on which dumpsters are located or proposed to be located. “Owner also includes any authorized agent of such person.

3. “Contractor” or “Dumpster Contractor” means person who, for compensation, supplies, maintains or services one or more dumpsters, or removes, transports or disposes of the contents thereof.

4. “Person” includes any individual, partnership, corporation, firm, association, or group.

5. “Board” or “Board of Health” means the Board of Health of the Town of Belmont.

6. No dumpster shall be used or kept in the Town of Belmont after December 31, 1983 unless a dumpster permit covering such dumpster has been issued to the Owner by the Board of Health.

7. Applications for dumpster permits may be made at the office of the Board. Each application shall include the name, address and telephone number of at least one Owner of the property where the dumpster is to be located; the name and address of the record holder of title to the property, if different; the name, address and telephone number of the contractor, if any, servicing the dumpster; and such other information as the Board may by rule require. All Dumpster permits shall expire at the end of the calendar year in which they are issued, but may be renewedannually on application as herein provided. The annual fee for each dumpster permit shall be $10.00.

8. The Owner shall ensure that each dumpster is so located as not to interfere with the health, safety, or well-being of any person

9. Each dumpster shall be of sufficient capacity to contain the material accumulated without overflowing, and shall be emptied when full.

10. Each dumpster used in whole or part for the storage or transportation of garbage, offal or other offensive substances shall be fitted with a ti.aht-fitting lid or cover, which shall be kept closed at all times except when the dumpster is being filled or emptied. Such lid shall be locked between 11:00 p.m. and 7:00 a.m.

11. No dumpster shall be emptied or filled between 11:00 p.m. and 7:00 a.m.

12. No dumpster shall be used for the disposal of liquids or organic matter unless the dumpster is emptied daily.

13. The Owner shall ensure that each dumpster and the area immediately surrounding it are kept free of odors, flies, insects, debris, overflow, and all other nuisances.

14. No person shall do business as a Dumpster Contractor in the Town of Belmont after December 31, 1983 without a Contractor’s permit from the Board of Health.

15. Applications for Contractor’s permits may be made at the office of the Board. Each application shall include the name, address and telephone number of the applicant; the name under which the applicant does business, if different from the above; the home address, home telephone number and signature of the applicant or of the president, general manager or other responsible officer of the applicant; and such other information as the Board may by rule require. Each Contractor’s permit shall expire at the end of the calendar year in which issued, but it may be renewed annually upon application as herein provided. The annual fee for a Contractor’s permit shall be $50.00.

16. Each dumpster owned, controlled or serviced by a Contractor shall be conspicuously marked with the name and telephone number of the Contractor. All other dumpsters shall be conspicuously marked with the name and telephone number of the Owner.

17. The Contractor, or, if none, the Owner shall ensure (1) that the dumpster contents are not spilled during removal or transportation; and (2) that each dumspter which it owns, controls or services is (a) deodorized when emptied and (b) washed or sanitized as necessary to maintain the dumpster in a sanitary condition.

18. Temporary dumpster permits may be issued to an Owner for a period not to exceed 30 davs. Such permits are renewable ‘or additional 30-day periods upon application as provided herein. Holders of temporary permits shall comply with all regulations applicable to holders of annual permits. The fee for each temporary dumpster permit shall be $10.00

9. If the Board of Health finds that any of these regulations have been violated and that the violation has not been corrected, it shall order the person or persons responsible to correct such violation within twelve hours or such other period as the Board may allow.

20. The Board may suspend or revoke any dumpster permit or Contractor’s permit upon a finding that the holder of such permit has violated any of these regulations or has failed to comply with any lawful order of the Board pursuant to these regulations. Additionally and not by way of limitation, the Board may suspend or revoke any Contractor’s permit upon a finding that the Contractor has repeatedly failed or neglected to sanitize, service or maintain dumpsters which such Contractor owns, controls, or is under contract to service.

21. Any person who shall fail to comply with any order issued pursuant to the provision of these regulations shall, upon conviction, be fined not more than five hundred dollars ($500.00). Each day’s failure to comply with an order shall constitute a separate offense.

22. If any provision of these regulations is declared to be unconstitutional or otherwise invalid, the remaining provisions shall continue in full force and effect.These regulations were adopted by the Board of Health of Belmont, Massachusetts at a meeting held on June 29, 1983 and amended on February 15, 1989 in accordance with the applicable provisions of Chapter 111, Section 31 of the General Laws.
